ADAM Legal Evening: Medical Council Reform Update

Date: Oct 27, 2026
Venue: Hyatt Regency Hong Kong, Tsim Sha Tsui
Symposium

Host: Association of Doctors in Aesthetic Medicine (ADAM)

On 27 October 2026, ADAM hosted an exclusive legal briefing for aesthetic medical practitioners, examining critical statutory reforms under the Medical Registration (Amendment) Bill 2026 alongside practical risk management, defence strategies, and community activities.

  1. 2026 Medical Registration Ordinance Amendment: A Brief and Its Effect on Doctors

Speaker: Dr David T. Y. Lam (LegCo Member)

  • MCHK Governance: Council membership expands from 32 to 35 (all appointed by the Chief Executive), raising lay representation from 8 to 11.
  • Disciplinary Restructuring: Preliminary Investigation Committee (PIC) and Inquiry Panels are replaced by the Medical Investigation Committee (MIC) and Medical Tribunal Panel (MTP), operating in smaller 5-member panels with independent assessor majorities to speed up resolutions.
  • Mandatory CME: Continuing Medical Education becomes compulsory for non-specialists to renew practising certificates, which will now have an extended 3-year validity.
  • Automatic Deregistration: Immediate deregistration or practising certificate suspension applies upon conviction for offences endangering national security (OENS) or serious crimes.
  1. The Practice of Aesthetic Medicine – Managing Risks and Complaints

Speakers: Ms Jaime Lam (Partner) & Ms Jennifer Lee (Senior Associate), Johnson Stokes & Master (JSM)

  • Informed Consent (Montgomery Standard): Clinicians must proactively explain material risks and alternatives; signed forms alone without meaningful dialogue fail legal requirements.
  • Tiered MTP Sanctions: New statutory penalties range from conditional practice and practising certificate suspensions to time-limited and permanent removal from the Register.
  • Aesthetic Case Insights: Analyzed practical liabilities in energy devices (Ultherapy burns), injectables (glabella swelling with improper remedial care), and online social media promotion violations.
  • Clinical Record-Keeping: Contemporaneous documentation detailing both positive and pertinent negative findings remains the foremost legal defence.
  1. From Prevention to Protection: Building the Gold Standard in Aesthetic Practice

Speaker: Ms Joeky Leung (Regional Development Director, Medical Protection Society - MPS)

  • Multi-Track Exposure: A single adverse event can spawn concurrent civil claims, disciplinary complaints, criminal proceedings, and coroner inquiries over multiple years.
  • Occurrence-Based Indemnity: Uncapped, occurrence-based protection provides peace of mind by covering incidents that occur during membership, regardless of when a claim is filed.
  • Proactive Wellbeing: The MPS Foundation invests directly in research on clinician wellbeing, risk mitigation, and safer practice.

Interactive Finale: Fun Games, Prizes & Social Pickleball Challenge!
The night wrapped up on high spirits with lively interactive games, an open medico-legal quiz, and exciting giveaway prizes that had attendees testing their regulatory trivia in good fun.

Keeping the community momentum going, members were also invited to swap their stethoscopes for paddles at the upcoming ADAM Social Pickleball Challenge this November!
